Nobody likes reading legal documents. We don't like writing them either. But this is a real place with real people in it, and California asks us to be thorough — so here it all is.
Nothing is hidden. If something doesn't make sense, just ask us.
Your right to cancel — California Law
You may cancel this agreement at any time prior to midnight of the fifth business day after the date of this agreement, excluding Sundays and holidays.
To cancel: mail or deliver a signed, dated written notice to Calmare House · 5639 La Jolla Blvd, 2nd Floor · Bird Rock, CA 92037 or email hello@calmarehouse.com. All payments will be refunded within 10 days.
Provided under the California Health Studio Services Contract Law, California Civil Code §§ 1812.80–1812.98. A copy of this signed agreement will be provided at the time of signing.
How billing works — California Law
This is a recurring monthly subscription. Your payment method is charged automatically each month until you cancel. To cancel, email hello@calmarehouse.com with 30 days' written notice.
Pursuant to California Business and Professions Code §§ 17600–17606. By agreeing to this membership you are providing affirmative consent to these automatic renewal terms.
Your membership tier and monthly rate are confirmed at sign-up. Fees are billed automatically to the payment method on file on the same calendar date each month. All payments are non-refundable except as expressly required by California law.
By agreeing to this membership, you authorise Calmare House to charge your payment method on a recurring monthly basis until you cancel in accordance with Section 5. You will receive an annual written reminder disclosing the renewal amount and how to cancel, as required by California Business and Professions Code § 17602(a)(3).
If you enrolled before Calmare House opened as a founding member, your rate is permanently locked for the lifetime of your active membership — it will never increase as long as your membership remains uninterrupted. If your membership lapses, is cancelled, or is paused beyond the permitted period and then restarted, the founding rate no longer applies and standard pricing will be charged from the date of restart.
Standard membership rates are subject to change. You will receive a minimum of 30 days' written notice by email prior to any price increase. If you do not wish to continue at the new rate, you may cancel before the change takes effect — no cancellation fee.
Members may pause their membership for up to 30 consecutive days per calendar year. Pause requests must be submitted in writing to hello@calmarehouse.com at least 7 days before the intended start date. During a pause, billing is suspended and membership benefits are unavailable. Requests are not retroactive.
Founding members who pause once per calendar year for up to 30 consecutive days retain their founding rate on resumption. A pause exceeding 30 days, or a second pause in the same calendar year, is treated as a lapse — standard pricing applies from the date of restart.
You may cancel at any time with 30 days' written notice to hello@calmarehouse.com. Cancellation becomes effective at the end of the billing period following the notice period. No partial refunds are issued for unused days within a paid period.
You may cancel immediately — without the 30-day notice period — in any of the following circumstances:
In circumstances (a), (b), and (c), no further charges will be made after the date of written notice, and any prorated refund due will be issued within 10 business days.
Bookings are confirmed on a first-come, first-served basis subject to capacity. You may cancel or reschedule at no charge up to 24 hours before your session.
A fee of $20.00 will be charged if you cancel less than 24 hours before your session or fail to show without notice. This represents a genuine estimate of the loss from an unfilled slot — not a penalty — and constitutes a valid liquidated damages provision under California Civil Code § 1671(b).
Three or more no-shows or late cancellations within any 60-day period may result in temporary suspension of online booking. You will be notified in writing before any suspension.
Calmare House is on the second floor of 5639 La Jolla Blvd, Bird Rock, CA 92037. Access requires a shared building staircase. There is no elevator at this time.
By agreeing to this membership, you acknowledge you have assessed your own ability to navigate stairs safely, accept responsibility for your safety on shared stairways, and will notify staff in advance if you need assistance.
Nothing here waives any rights under the ADA or California accessibility laws. Obligations relating to the building's physical accessibility rest with the building owner. Calmare House will work in good faith to accommodate access needs within its control.
Calmare House provides wellness services — contrast therapy (infrared and traditional sauna with cold plunge), compression therapy, red light therapy, and related recovery modalities. These are wellness services only. Nothing here constitutes medical treatment, advice, diagnosis, or a substitute for professional medical care.
Use of our services carries inherent risks including but not limited to: overheating or heat exhaustion from sauna use; cardiovascular stress from temperature contrast; vasovagal response, dizziness, or cold shock from cold plunge; skin or eye sensitivity from red light; slips and falls in wet areas; and aggravation of pre-existing conditions.

Pregnant members must obtain written clearance from their healthcare provider before using cold plunge or contrast therapy, infrared sauna, or compression therapy. If you become pregnant during an active membership, please notify us and obtain clearance before continuing these services.
Do not use compression therapy if you have deep vein thrombosis (DVT) or a history of blood clots, severe peripheral arterial disease, active blood clots in the limbs, congestive heart failure (unless your physician has given explicit approval), or acute infections affecting the limbs.
Please notify us in writing if your health status changes in a way that may affect your safe use of the facility. We cannot be held responsible for outcomes arising from conditions you haven't disclosed.
Staff may, in their reasonable discretion, decline to permit use of any service or area if they have a genuine concern for your health or safety — including apparent intoxication, visible illness, undisclosed injury, or signs of impairment.
You voluntarily and knowingly assume all risks associated with your use of Calmare House, to the fullest extent permitted under California law. You confirm you are physically capable of participating in your chosen services and have obtained appropriate medical advice where relevant.
Please read this carefully. By agreeing to this contract, you are giving up certain legal rights.
To the fullest extent permitted by California law, you agree to release, waive, and hold harmless Calmare House, its owners, directors, officers, employees, contractors, agents, and affiliated partners from any and all claims, damages, losses, or liabilities of any kind — known or unknown — arising from your use of Calmare House facilities and services, including:
This release does not apply to the gross negligence or wilful misconduct of Calmare House.
You expressly waive the protections of California Civil Code § 1542:
"A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or releasing party."
You agree this release shall remain effective notwithstanding any facts you may later discover.
You agree to indemnify and hold harmless Calmare House from any claims, losses, or costs (including reasonable legal fees) arising from your breach of this agreement, misuse of the facility, or any injury or damage you cause to another person or to property.
Calmare House maintains general liability insurance for the facility and its operations. We do not provide personal health, accident, disability, or any other personal coverage for members or guests. You are solely responsible for maintaining your own appropriate insurance.
Calmare House reserves the right to deny entry to anyone who appears intoxicated, visibly impaired, or unwell; refuse access to any specific service on health or safety grounds; and suspend or permanently terminate a membership without refund if a member:
Members will be given written notice of any suspension or termination. Terminations on grounds of conduct are not eligible for refund.
Member perks are provided as a courtesy and may be modified with 30 days' prior written notice. Current perks are listed in your membership confirmation.
KOI Wellbeing discount: All active Calmare House members receive 20% off one IV infusion per month at KOI Wellbeing (NAD+ excluded), subject to availability. Redeemed directly with KOI Wellbeing at the time of service. Calmare House is not responsible for KOI Wellbeing's services, availability, pricing, or policies — they are an independently operated business.
Calmare House may modify, temporarily suspend, or permanently discontinue any service or facility feature. Where a modification results in the permanent removal of a primary service that was available at sign-up, you retain the right to cancel your membership per California Civil Code § 1812.85(c), and a prorated refund of any prepaid amounts will be issued.
Temporary closures for maintenance, repairs, or circumstances beyond our reasonable control (public health orders, utility outages, building access issues) do not constitute grounds for cancellation or refund.
Each Guest Pass entitles one named guest to one complimentary visit in the billing month it is issued. Guest passes expire at the end of that billing month and do not roll over; cannot be transferred, sold, or redeemed for cash; require the guest to complete a health intake form and liability waiver before their session; and are subject to availability and must be booked in advance. We reserve the right to refuse entry to any guest who doesn't meet health, conduct, or facility requirements.
Photography or video may occasionally be captured in communal areas for marketing and social media. If you'd prefer not to appear in any such content, let a member of staff know before your visit — opt-out requests are always respected.
You retain ownership of any personal photography you take on the premises, subject to the conduct rules in Section 12.
Calmare House collects and processes your personal data — name, contact details, health information, and payment information — solely to manage your membership, process payments, operate the facility safely, and communicate with you about your account.
We do not sell your personal data to third parties. Ever.
As a California resident, you have the following rights under the California Consumer Privacy Act (Cal. Civ. Code § 1798.100 et seq.):

This agreement is governed by the laws of the State of California. In the event of a dispute, the parties agree to first attempt informal resolution by contacting us in writing at hello@calmarehouse.com. If not resolved within 30 days, disputes shall be resolved in the state or federal courts of San Diego County, California.
If any provision of this agreement is found unenforceable or invalid, it shall be modified to the minimum extent necessary, or severed if modification is not possible — without affecting the remaining provisions.
This agreement, together with any health intake forms completed at sign-up or on arrival, constitutes the entire agreement between you and Calmare House regarding your membership. No verbal representations by staff are binding unless contained here.
Calmare House may update these terms with a minimum of 30 days' written notice by email. Your continued use of your membership after the effective date constitutes acceptance of the updated terms. If you don't accept updated terms, you may cancel before they take effect — no penalty.
If staff reasonably believes a member or guest is experiencing a medical emergency, they may contact emergency services (911) and provide information necessary to protect health and safety, including relevant health information from intake forms. The member remains solely financially responsible for any medical treatment received. Calmare House accepts no liability for actions taken in good faith during an emergency.
